Terms and Conditions

These terms and conditions are in relation to business and work carried out by Up North Cabinet Makers Ltd, a company registered in England and Wales under number 13563514 whose registered office is at 329 Petre Street, Sheffield, S4 8LJ. 1. Acceptance of Contract

A contract is formed between a customer (referred to as the “Customer”) and Up North Cabinet Makers Ltd (referred to as the “Company”) when an Order is received from the Customer. An Order is made by accepting the terms in a Quote, in written, verbal or electronic form. By ordering any Product or Service you agree to be bound by these Terms and Conditions. The Product or Service shall mean any product or service that is provided by the Company to the Customer. These conditions do not affect your statutory rights.

 

2. Supply

The Company agrees to supply the product(s) or service(s) to the Customer as detailed in the Quote and according to the terms and conditions of this contract.

 

3. Rights Reserved

Should the Company choose not to enforce any or all of these conditions it should not be interpreted as a waiver of any of the Company’s rights. By providing the Company with an Order, the Customer accepts these terms and conditions.

 

4. Payment

The Company shall issue an invoice to the Customer in respect of products or services supplied, or to be supplied. Payment terms will be stipulated on any invoice issued by the Company. These may include non-standard or special clauses which the Company may reasonably request of the Customer. Where a deposit is specified in the Quote no work shall be undertaken until the deposit is received. The Company reserves the right to charge interest on overdue amounts at an annual rate of 5% above the Lloyds Bank base rate ruling on the date payment is due. Title in the goods or services shall remain with the Company until full payment has been received, unless otherwise stipulated in the Quote.

 

5. Health & Safety

The Company and Customer will act in accordance with all relevant health and safety requirements in order to provide the product(s) or service(s).

 

6. Work Description

We will ensure that all Products and Services provided are made or performed with reasonable care and skill and to a reasonable standard. No variation of the Contract, whether about description of the Products, fees or otherwise, can be made after it has been entered into unless the variation is agreed by the Customer and the Company in writing.

 

7. Cancellation

You may withdraw your Order at any point prior to payment of the deposit without incurring any liability.

This is a distance contract in which the Customer has statutory cancellation rights known as a ‘cooling off’ period. This period begins on the Customer’s accepting the terms of a quote and ends 14 days after receipt of the Product, or in the case of a Service, 14 days after the Order was made. However these cancellation rights do not apply to Products which are made to your specifications or to inseparably mixed goods.

If you wish to terminate the contract outside of the cooling off period you will be refunded for any service not yet provided and invoiced for any Service that has been provided or Product that has been manufactured in full or in part.

 

8. Liability

Products manufactured by the Company are subject to a 5 year guarantee, beginning from the completion date of delivery, against material defects or flaws, excluding wear and tear. When reported within the 5 year period defects or flaws will be rectified with no cost to the Customer.

The Company accepts no liability for problems caused by incorrect or incomplete information provided by the Customer, or for any problem caused by a third party contractor not provided by the Company.

In the unlikely event of the Company being unable to supply the product(s) or service(s) as specified in the Quote, liability shall be limited to the total invoice value – or monies already paid by the Customer.

 

9. Data Protection

The Company has the right to record, store and distribute any video and photo data on its premises and on the premises or private property of any customer they are currently providing a service to for marketing purposes, unless agreed otherwise.

10. Complaints Procedure

In the unlikely event of a dispute over the supply of product(s) or service(s) please contact us by email or telephone. Any disputes must be notified within 28-days of the Customer receiving the product(s) or service(s).

 

11. Care and Damage to Customer property

Whilst every care is taken in the handling of the Customer’s property, if the Company causes any damage to the property through negligence during delivery or installation then the Company will make good that damage at no additional cost to the Customer. This does not cover pre existing faults or damage.

 

12. Right of Assignment

The Company retains the right to assign the supply of the product(s) or service(s) to the Customer to another suitable company should they be unable to complete these terms and conditions.

 

13. Basis of law

These Terms and Conditions and any accompanying letter, invoice and/or contract are governed by the laws of the United Kingdom.
